The double taxation treaty between the USA and Malta was ratified by Malta on the 23rd November following ratification by the US Senate.
The DTA will, which will come into force on 1st January 2011, is aimed at providing certainty on cross border trade and activities and contains a number of measures aimed at limiting withholding tax on Malta-bound dividends, royalties and other income. The treaty contains comprehensive limitation of benefits and exchange of information provisions. The agreement was signed by American Ambassador Douglas Kmiec and Finance Minister Tonio Fenech.
We will be posting more comments and views about tax planning opportunities provided by the DTA in due course.
