Our Tax Practice
Our tax practice is focused on cross-border corporate transactions and we provide commercially driven solutions taking into account the client’s targets and requirements. We have extensive expertise in Maltese tax but we also have knowledge of foreign tax systems and trends. This knowledge, coupled with that of Malta’s double taxation network and EU tax legislation, enables us to provide holistic solutions to multi-national clients engaged in multi-jurisdictional transactions.
Corporate Transactions & VAT
Corporate tax and VAT can have a significant impact on the success of a deal. We advise on all tax and VAT aspects of local and international transactions such as the setting up of holding and trading structures, group reorganisations, asset finance and management, M&As and transfers of going concerns. To date, we have advised clients on aircraft, yacht and ship operations and financing, real estate acquisition, internet gaming and betting operations, film & audiovisual production and other specialised industries.
Our tax advice goes beyond the provision of detailed information about Malta’s attractive tax regime as we make sure that any structure or transaction involving Malta will also be tax efficient in the relevant jurisdictions where the client is based or operates. To this end, we analyse potential foreign tax implications (particularly, the presence of permanent establishments outside Malta) and where necessary, we involve foreign tax consultants to support us on foreign tax issues.
We offer a comprehensive range of tax services for private clients including representation. We regularly advise private clients on Maltese and foreign tax issues arising in the course of a relocation or transfer of residence to Malta (for retirement, business or employment purposes). We also advise clients on the various tax implications associated with inheritance and estate planning, asset protection and related matters.
Tax Representation and Disputes
We represent corporate and private clients in tax disputes our involvement will typically commence at tax audit stage where we assist clients throughout tax investigations and meetings with the Maltese tax authorities. We also provide assistance to clients during formal assessments reviews and by making submissions and representations during tax appeals before the Maltese tax tribunal and the Maltese Superior Courts.
