Right To Submit Freedom Of Information Requests Extended To Non-Residents

On the 24th of March 2022 the Maltese Data Protection Appeals Tribunal ruled in favour of Access Info Europe in a dispute regarding a freedom of information request made by Access Info to the Ministry of Home Affairs and National Security, under the Maltese Freedom of Information Act.

The freedom of information request was rejected by the Ministry on the basis that Access Info did not qualify as an “eligible person” since it was not resident in Malta for at least 5 years. This interpretation was subsequently confirmed by the Information and Data Protection Commissioner.

Access Info, represented by Fenech Farrugia Fiott Legal, successfully appealed this decision. The Data Protection Appeals Tribunal decision is subject to appeal.
